Decree 13/2023/ND-CP
On Personal Data Protection
This decree provides comprehensive regulations on the protection of personal data in Vietnam, requiring companies to adopt stringent measures to ensure data privacy and security. It outlines the rights of data subjects, the obligations of data controllers and processors, and the penalties for non-compliance.
Decree 53/2022/ND-CP
On the Implementation of the Cybersecurity Law:
This decree provides guidance on implementing the Law on Cybersecurity, focusing on the protection of national security, social order, and safety in cyberspace. It mandates companies to store certain types of data within Vietnam and comply with government requests for information when necessary.
Law on Cybersecurity (2018)
Enacted to protect national security and maintain public order, this law imposes strict requirements on businesses operating in Vietnam, particularly those handling sensitive information. It includes provisions on data localization, cybersecurity risk management, and the establishment of a legal framework for cybercrime prevention.
Law on Telecommunications (2009)
This law governs the telecommunications sector in Vietnam, focusing on the provision, management, and use of telecommunication services. It includes regulations on network infrastructure, service quality, and the protection of users’ rights, which are particularly relevant for companies providing IT and telecommunication services.
Draft Data Protection Law
(under development)
Although not yet finalized, the Draft Data Protection Law aims to further enhance the legal framework for data protection in Vietnam. It is expected to introduce stricter requirements for data processing, cross-border data transfers, and the rights of data subjects, aligning more closely with international standards like the GDPR.
